if your ipod's headphones fail during the warranty period you can get them replaced. what's more, they're on the house. it's too bad that it's not really common knoweldge.
mine died after they fell out of my ears and hit the ground. to be honest, i wasn't looking forward to buying a new pair. especially seeing as how the cheapest ones go for $39 and come with a remote. i couldn't stand using a set of 99-cent store earbuds anymore and i picked up some sony ear goggles. the sound's not superb, but it's still better than nothing.
